THE WINDMILL TILTS BACK: WIND POWER IN THE AGENCIES, THE LEGISLATURE, AND THE COURTS
Turbines begin to turn, and the legal system begins to take account of them.  Wind power, an unprecedented technology, impacts large economic interests, consumers, and wildlife, and has sparked struggles all over the legal landscape.  This program examines the regulatory structures being created on both the state and federal levels to license wind power generation and enable the transmission and sale of the power to consumers, the compromises being forged in lawsuits over wildlife impacts, the possible impact of local zoning barriers, and the thrust and parry of the lawmaking process in the Maryland legislature as it dealt with the attempt this last session to create a charter for offshore wind farms.

NUTS & BOLTS OF E-DISCOVERY
This program will consist of two common scenarios in e-discovery.  The first is a discussion between counsel, their technical experts, and the client to determine the boundaries of the duty to preserve information.  They will develop a discovery plan to present at a “meet-and-confer” conference of the parties.  The second scenario is the “meet-and-confer” conference under Federal Rule 26(f)/Md. Rule 2-504.1, at which two opposing parties negotiate the scope of preservation, the form of production of electronic documents, and privilege issues.  This session is presided over by a mediator/judge, who will provide commentary.  The result is an oral report on the areas of agreement and disagreement, and where court intervention is necessary.

BANKRUPTCY WARS: THE CONTINUOUS SPIRAL OF COMPETING FORCES IMPACTING DEBTOR CREDITOR RELATIONS
The Supreme Court has rendered an extraordinarily prolific number of recent opinions which have construed and further defined consumer bankruptcy practice under the 2005 revisions to the United States Bankruptcy Code known as the Bankruptcy Abuse Prevention And Consumer Protection Act of 2005 (“BAPCPA”).  This program in part examines those opinions with a view toward providing the practical application of those rulings to current consumer bankruptcy practice.  In addition, the Consumer Bankruptcy Section is proud to present its third annual federal legislative update of proposed and pending financial legislation of interest to the insolvency community, presented by Samuel J. Gerdano, the Executive Director of the American Bankruptcy Institute.  The section will additionally will present a Maryland legislative update of pending and proposed state legislation which impacts the insolvency community.  Moreover, for the second time since 2008, and due to a continuous and evolving metamorphosis in state foreclosure law, the Consumer Bankruptcy Section is proud to welcome back the pre-eminent foreclosure practitioner, Kenneth MacFadyen, who will present an update on the current state of foreclosure practice in Maryland.  Rounding out our program will be a discussion of certain additional hot topics impacting local consumer bankruptcy practice.
